Whitehall man who police say plowed car into 2 people in deadly parking lot encounter to face county court

A 55-year-old Whitehall man who killed a man and seriously injured a woman will face county court on homicide and related counts.

ALLENTOWN, Pa. — A 55-year-old Whitehall man charged with intentionally plowing his car into a group of people in a Whitehall Township apartment complex, killing a man and seriously injuring a woman, will face county court on homicide and related counts.

Rajgion Davis of Whitehall, was ordered by District Judge Jacob E. Hammond at a preliminary hearing Wednesday to face homicide and two counts each of attempted murder and aggravated assault, all first-degree felonies.

Killed was Stephen S. Fistner, 53, of Whitehall. He and his wife, Yesenia, were walking their dog just after 6 p.m. Aug. 9.

Davis, who remains in county jail without bail, will be formally arraigned Oct. 30 before county Judge Thomas M. Caffrey.

The case will be prosecuted by Chief Deputy District Attorneys Christine F. Murphy and V. Paul Bernardino, III.

Killed was Stephen S. Fistner, 53, of Whitehall. He and his wife, Yesenia, were walking their dog just after 6 p.m. Aug. 9.

Numerous eyewitnesses described an incident that later was determined to be an intentional act by Davis when they stopped in the parking lot to assist Francesca Washington.

Her unoccupied Toyota RAV-4 had been rammed a short while earlier by Davis as he drove a gray sedan, witnesses told police.

Accused returns to scene

As the three stood in the lot, Davis reappeared in the car and drove directly at them, according to the district attorney’s office.

A witness described Stephen Fistner pushing his wife out of the way of Davis’ car immediately before a violent impact between the car, Washington, Stephen Fistner and two other unoccupied vehicles.

Fistner, 53, was pronounced dead about an hour after the incident at Lehigh Valley Hospital-Cedar Crest.

Washington "suffered grievous bodily injury and remains hospitalized," according to the district attorney's office.

The crash crippled Davis’s car but he allegedly walked away. Police said several people assisted the victims and followed Davis while recording him with their cellphones.

They directed police from Whitehall, Allentown and South Whitehall Township to him.

He was arrested by Allentown officers and allegedly told them his intention was to harm and kill Washington.
